R52 VOLUNTEER PARTICIPATION, ASSUMPTION OF RISK & LIABILITY WAIVER
This Volunteer Participation, Assumption of Risk & Liability Waiver (“Agreement”) is made between:
- R52 and its related entities (collectively, “R52”) and
- The undersigned volunteer (“Volunteer”).
R52 is a multi-layered ecosystem that collaborates with local businesses and partners to deliver programs, tools, and community support.
In consideration of being allowed to participate in volunteer activities connected with R52 and its local business partners, the Volunteer agrees as follows:
1. Parties Covered by this Agreement
For purposes of this Agreement, the term “R52 Released Parties” includes:
- R52 and any of its parents, subsidiaries, affiliates, licensees, and successors;
- Any local businesses, host organizations, or community partners that R52 works with in connection with the volunteer activities (“Host Businesses”);
- Their respective owners, directors, officers, employees, agents, contractors, volunteers, and representatives.
This Agreement is intended to protect all R52 Released Parties to the fullest extent permitted by applicable law.
2. Description of Volunteer Activities
The Volunteer understands that activities may include, but are not limited to:
- Assisting local businesses (e.g., hospitality, wellness, retail, tours, events, community outreach and more more);
- Supporting R52 programs or initiatives (such as R52 Chapter / District Activities or community events);
- Participating in trainings, meetings, demonstrations, street‑level outreach, set‑up/tear‑down, light physical tasks, and related travel to and from these activities.
These activities, and any other activities reasonably related or incidental to them, are collectively referred to as the “Activities.”
3. Volunteer Status (Not an Employee)
The Volunteer understands and agrees that:
- The Volunteer is participating freely and is not an employee of R52 or any Host Business.
- The Volunteer is not entitled to wages, benefits, workers’ compensation, or unemployment insurance in connection with the Activities.
- Nothing in this Agreement creates an employment, partnership, or agency relationship between the Volunteer and any R52 Released Party.
4. Health, Fitness & Personal Responsibility
The Volunteer represents and warrants that:
- They are physically and mentally able to participate safely in the Activities.
- They are responsible for monitoring their own condition and will immediately stop participating and notify an R52 or Host Business representative if they feel unsafe, unwell, or unable to continue.
- They will follow all reasonable instructions, safety guidance, and codes of conduct provided by R52 and any Host Business during the Activities.
The Volunteer understands that it is their responsibility to consult a physician about participation if they have any health concerns.
5. Assumption of Risk
The Volunteer understands that participation in the Activities may involve inherent and unforeseen risks, including but not limited to:
- Slips, trips, and falls;
- Minor injuries (scrapes, bruises, strains), and more serious injuries (sprains, broken bones, concussion or similar);
- Exposure to weather, local environmental conditions, or crowded public areas;
- Interaction with members of the public;
- Travel to, from, and between activity locations;
- Other risks typical of community, hospitality, or event‑related volunteer work.
The Volunteer knowingly and voluntarily assumes all such risks, whether known or unknown, foreseeable or unforeseeable, arising out of or related to the Activities, to the fullest extent permitted by law.
6. Release of Liability & Covenant Not to Sue
To the fullest extent permitted by applicable law, the Volunteer hereby:
- Releases and forever discharges all R52 Released Parties from any and all claims, demands, actions, causes of action, damages, costs, or expenses of any nature whatsoever, arising out of or in any way related to the Volunteer’s participation in the Activities; and
- Agrees not to sue any of the R52 Released Parties for any such claims.
This Release applies to claims based on:
- Ordinary negligence of any R52 Released Party;
- Negligent acts or omissions of other volunteers or participants;
- Any other theory of recovery, except to the extent such claims may not lawfully be released (for example, gross negligence, willful misconduct, or where releases are prohibited by local law).
Nothing in this Agreement is intended to waive rights that cannot be waived under applicable law.
7. Indemnification
To the fullest extent permitted by law, the Volunteer agrees to indemnify, defend, and hold harmless the R52 Released Parties from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- The Volunteer’s participation in the Activities;
- The Volunteer’s violation of this Agreement or of any instructions, rules, or policies communicated by R52 or a Host Business;
- The Volunteer’s negligent or wrongful acts or omissions.
This duty to indemnify does not require the Volunteer to indemnify any party for that party’s own gross negligence or willful misconduct where such indemnification is prohibited by law.
8. Medical Treatment & Insurance
- The Volunteer authorizes R52 and Host Businesses to obtain emergency medical treatment for the Volunteer if, in their reasonable judgment, it appears necessary and the Volunteer is unable to consent.
- The Volunteer understands and agrees that they are responsible for all costs of such treatment, and that R52 is under no obligation to provide medical insurance or coverage.
- The Volunteer acknowledges that they are responsible for maintaining their own health, travel, or accident insurance, as they deem appropriate.
9. Conduct, Values & Local Respect
The Volunteer agrees to:
- Treat all team members, local businesses, and community members with respect and professionalism, consistent with the spirit of the “R52 Way,” which emphasizes authenticity, honorable conduct, and proof through action.
- Follow all lawful instructions given by R52 personnel, Host Business staff, or designated coordinators during the Activities.
- Refrain from harassment, discrimination, violence, or any illegal or unsafe behavior.
- Respect local customs, culture, and regulations of the region in which the Activities take place.
R52 reserves the right to end a Volunteer’s participation at any time for conduct that, in its sole discretion, is unsafe, disrespectful, disruptive, or inconsistent with R52 values.
10. Confidentiality & Data Protection
The Volunteer may have access to confidential information about R52, Host Businesses, or customers (including but not limited to contact details, operational information, customer feedback, and business strategies).
The Volunteer agrees to:
- Keep such information confidential and not disclose it to any third party without written permission from R52 or the relevant Host Business.
- Use any such information solely for the purpose of performing the Activities.
- Comply with any applicable data protection or privacy policies communicated by R52 or the Host Business.
This obligation continues even after the Volunteer’s involvement with R52 ends.
11. Photo, Audio & Video Release
The Volunteer understands that R52 and Host Businesses may wish to photograph, film, or otherwise record the Activities for documentation, storytelling, and promotional purposes, including but not limited to R52, Host Business, websites, social media and more.
By agreeing to this document, the Volunteer:
- Grants R52 Released Parties a worldwide, royalty‑free, perpetual, and irrevocable license to use the Volunteer’s name, likeness, image, voice, and statements captured during the Activities, in any media now known or later developed, for lawful purposes related to R52’s mission, including marketing, education, and documentation.
- Understands that they will not be compensated for such use.
- May revoke this permission in writing for future recordings if required by local law, understanding that materials already produced or published may continue to be used.

12. Content Creation Release Agreement
Grant of Rights
By submitting any content (including but not limited to photos, artwork, videos, blogs, written material, digital assets, or creative items) to R52 or any Host Business affiliated with R52, the Volunteer expressly grants R52 and the Host Business the perpetual, worldwide, royalty-free right to use, reproduce, modify, display, publish, distribute, and otherwise utilize the submitted content for any purpose related to their mission, activities, marketing, and operations.
Volunteer Publication Limits
Volunteers may not publish, distribute, or release any content on behalf of R52 or any Host Business, whether online or offline, without receiving written approval for each individual item from authorized representatives of R52 or the Host Business.
Ownership and Attribution
The Volunteer acknowledges that submitted content may be used without additional permission or compensation. R52 and Host Businesses may attribute the work to the Volunteer at their discretion but are not required to do so.
Copyright and Third-Party Material
Volunteers guarantee that submitted content is original or properly licensed for such use and does not infringe on any third-party rights. Any material containing third-party content must include appropriate licenses or permissions.
13. Minors
This Agreement is intended for Volunteers who are at least 18 years of age (or the age of legal majority in the relevant jurisdiction).
If a Volunteer is under the age of majority, a separate parental/guardian consent and waiver form will be required, and the minor Volunteer may not participate unless that form is properly signed and accepted.
14. Governing Law & Severability
- This Agreement shall be governed by and construed in accordance with the laws of Unites States, California, Ventura Country & United States, Texas, Bexar County without regard to its conflict of law principles.
- If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
- This Agreement constitutes the entire understanding between the parties with respect to the subject matter and supersedes any prior discussions or representations regarding the Volunteer’s participation in the Activities.
15. Acknowledgment & Signature
By Agreeing, the Volunteer acknowledges and agrees that:
- They have read this entire Agreement, understand its terms, and sign it freely and voluntarily.
- They understand that they are giving up certain legal rights, including the right to sue the R52 Released Parties for ordinary negligence, to the extent permitted by applicable law.
- They agree to be bound by this Agreement for all current and future Activities with R52 and relevant Host Businesses, unless and until it is revoked in writing and accepted by R52 (provided that such revocation will not affect any claims that have already arisen).
